The Ghana Railway Development Authority (GRDA) has issued a stern warning to the public against acquiring or leasing railway lands and buildings from individuals without official authorization. This caution follows reports of illegal sales and leases of railway properties in the Western, Western North, and Ashanti Regions.
These unauthorized transactions, some involving former employees of the now-defunct Ghana Railway Company Limited (GRCL), are occurring without the GRDA's consent. The Authority states that these dealings breach the laws governing the management and disposal of railway assets. The GRDA has confirmed that such transactions violate the Railways Act, 2008 (Act 779), and the Public Financial Management Act, 2016 (Act 921).
This issue highlights a persistent challenge in Ghana regarding the management of state assets and public lands. The unauthorized sale of public property can lead to significant financial losses for the state and create legal complications for unsuspecting buyers. Previous instances of land encroachment and illegal property transactions have often resulted in prolonged disputes and stalled development projects across the country.
The GRDA categorically states that such transactions are unlawful and will not be recognized by the Authority. It will not regularize any lease agreements or transactions involving railway lands and buildings executed without the requisite approvals. The Authority also noted that these dealings contravene government directives concerning the disposal of public lands and state assets.
The GRDA urges the public to exercise due diligence and confirm with the Authority before engaging in any transactions involving railway properties. Any person who engages in such unauthorized transactions does so entirely at their own risk. The Authority is collaborating with relevant state institutions to investigate these alleged illegal activities and will take legal action against culpable individuals. Only transactions officially approved by the GRDA will be deemed valid, ensuring proper oversight and adherence to legal frameworks for railway infrastructure development.
This warning from the GRDA underscores the government's commitment to protecting state assets and ensuring orderly development of critical infrastructure. The railway sector is a key component of Ghana's economic growth strategy, with significant investments planned for expansion and modernization. Illegal land transactions could impede these vital projects, affecting the nation's long-term economic prospects and transport efficiency. The public's adherence to official procedures is crucial for the successful implementation of railway development plans and for maintaining the integrity of public land administration.
